By using this site, you, the Customer, agree that you have read and agree to be bound by the following Terms & Conditions. These Terms & Conditions are subject to change without notice. Any changes will be incorporated into the Terms & Conditions posted to this website from time to time. Customer's continued use of the website or the parkingticket.com helpdesk, following the posting of any changes to the Terms & Conditions, constitutes acceptance of those changes.Contacting our helpdesk with questions constitutes use. If you do not agree with these Terms & Conditions, please do not access this website or our helpdesk. I. Ticket Fighting
1. Customer agrees not to copy, edit, forward, reproduce or digitally or electronically edit or modify any part of parkingticket.com website, or any customized Work Matter prepared by parkingticket.com on behalf of Customer. Work Matter is defined as all work that is prepared by parkingticket.com on behalf of Customer and may be forwarded by parkingticket.com or its assigns. All Work Matter, which is customized by nature, includes but is not limited to Dismissal Request Letters, Copy Request Letters, Appeal Letters, and Administrative Dismissal Requests and requests for judicial intervention by the courts. Customer understands and agrees that only photocopies are allowed for record-keeping purposes, not digital scans or computer or typewritten copies in any form except when the Ship4Me Service is used. (Please see paragraph 33 for details.) Customer understands that all Work Matter prepared on behalf of Customer by parkingticket.com is the intellectual property of parkingticket.com and may only be accessible to Customer for a limited time, after which it may be archived, deleted or permanently removed from Customer's online account at the sole discretion of parkingticket.com.
2. Parkingticket.com agrees to guarantee that Customer's parking ticket will be dismissed or reduced and Customer agrees to pay a fee to parkingticket.com, hereinafter known as the Guaranteed Dismissal Fee or Pay Per Ticket Fee, which is equal to half the price of the savings,based upon the original parking ticket base fine plus any accrued penalties, fines, interest or related charges.
3. Customer agrees the parking ticket they enter into the parkingticket.com web site is NOT in Judgment as of the date it is entered (the "Entry Date"). If the parking ticket is in Judgment or goes into Judgment, or if the "Entry Date" is more than 60 days after the ticket issue date, Customer agrees that parkingticket.com offers no guarantee as to dismissal. Note: the parkingticket.com "Entry Date" is defined as the date the parking ticket is completely and accurately entered and submitted by the Customer.
4. Should Customer's parking ticket be found Guilty for the full amount on both an Initial Hearing and an Appeal Hearing using the Dismissal Letter and Appeal Letter prepared by parkingticket.com, and judicial intervention if requested by parkingticket.com, Customer agrees and understands that Customer will be responsible for paying the Municipality the cost of the parking ticket and that parkingticket.com will refund to the Customer the Guaranteed Dismissal or the Pay Per Ticket Fee paid, as long as Customer has met all of their obligations which are outlined below in paragraph 11.
5. Delivery fees.
- Non Ship4Me Service Customers: Standard delivery via email of Dismissal Letter, prepared by parkingticket.com on behalf of customer, is provided at no additional charge. All other delivery options are provided at additional cost to the Customer. Delivery fees are not cancelable or refundable under any circumstances.
- Ship4Me Service Customers: Customers who require no evidence and contest tickets issued in New York City are eligible for free Standard Ship4Me Service. Standard Ship4Me Service is defined in Paragraph 33 and within. Standard Ship4Me Service ships within 3-5 business days. All other Ship4Me Service shipping options (i.e. same day shipping, next day shipping, web upload to municipal websites or similar, etc) are provided at Customer's option, at an additional cost. Ship4Me Service fees are not cancelable or refundable under any circumstances.
6. Email Notification.
- Non Ship4Me Service Customers: parkingticket.com will send an email notification to Customer once all work matter, prepared by parkingticket.com on behalf of customer, is available on the parkingticket.com website. Customer understands and agrees that the email notifications detailed above are courtesy notifications, and that parkingticket.com is not responsible if the courtesy notification email is not received by the Customer. Customer hereby understands and agrees that it is Customer's sole responsibility to periodically check their My Account section and their overall customer account maintained on the parkingticket.com website for the status of their work matter.
- Ship4Me Service Customers: Parkingticket.com will send an email alerting Customer when parkingticket.com prints all work matter, prepared by parkingticket.com on behalf of customer. A second email containing a United States Postal Service Delivery Confirmation number will also be sent to Customer once Customer's customized work matter is shipped to the municipality unless provided to the municipal website via an upload or email. Customer understands and agrees that the email notifications detailed above are courtesy notifications, and parkingticket.com is not responsible if the courtesy notification email is not received by the Customer. Customer hereby understands and agrees that it is Customer's sole responsibility to periodically check the My Account section of the parkingticket.com website for the shipment status of their work matter.
7. Delivery Terms.
- Non Ship4Me Service Customers: Customer agrees to provide to the Municipality the work matter forwarded to Customer by parkingticket.com. Customer also agrees to follow all instructions and include all attachments noted within all work matter, prepared by parkingticket.com on behalf of customer, as well as noted in the "Instructions" page. The "Instructions" Page is included with every Dismissal Request Letter. Such attachments may include a copy of the Vehicle Registration Certificate, photographs, a delivery bill or service ticket, a driver delivery or service affidavit, Notary and other items. Customer specifically agrees that Customer must mail the above noted paperwork to the Municipality within three (3) calendar days of the date that all work matter, prepared by parkingticket.com on behalf of customer, is generated by parkingticket.com or its assigns.
- Ship4Me Service Customers: Customer authorizes parkingticket.com to generate and ship all work matter, prepared by parkingticket.com on behalf of customer, to the municipality where the ticket was issued in any manner including hand delivery, fax, website uploads, US Postal Service, or any other courier or packaging service. Customer also agrees to authorize parkingticket.com to prepare a facsimile of Customer's vehicle registration certificate based upon Customer's entries and to submit same along with a facsimile of Customer's parking ticket, based upon the customer's entries into the parkingticket.com website. Should Customer receive a Notice of Determination (Initial Hearing Result) from the municipality, Customer agrees to forward such notice to parkingticket.com via fax or online upload.
8. Should Customer receive a Copy Request Letter from parkingticket.com during the course of fighting a ticket, Customer agrees to mail said Copy Request Letter to the Municipality within three calendar (3) days of the date it was generated by parkingticket.com. Customer further agrees to promptly return to the parkingticket.com website and enter the information from the official parking ticket they have received from the City within three calendar (3) days. Should Customer receive any Penalty Notices from the respective Municipality during the course of fighting a ticket, Customer agrees to keep parkingticket.com informed by going to the parkingticket.com web site and entering the information the Customer has received from the Municipality.
9. Upon Customer's receipt of the Notice of Determination (stating if Customer's parking ticket has been found Not Guilty or Guilty) from the Municipality, Customer agrees to return to the parkingticket.com web site and enter that information in the appropriate area marked "Enter Hearing Determination" or other such similar area of the parkingticket.com website, so designated for hearing determinations. If found Guilty, Customer agrees to make payment to the Municipality timely, in accordance with the instructions sent to Customer by the Municipality.
10. Appeal Process.
- Non Ship4Me Service Customers: If Customer enters a "Guilty" Notice of Determination into the parkingticket.com web site, Customer agrees and understands that parkingticket.com will forward to Customer an Appeal Form, via email or via a web link or through some other method, which Customer agrees to complete and provide to the Municipality requesting a second (2nd) Hearing on the ticket. This Appeal Form is a request to have the original Hearing reversed and the ticket dismissed. Customer agrees to file an Appeal Form within the time allowed by the Municipality and no later than three calendar (3) days after Customer's receipt of a Guilty Determination from the respective Municipality. Customer also recognizes and accepts all responsibilities for all parking ticket payments that may be incurred during this process.
- Ship4Me Service Customers: If Customer enters a "Guilty" Notice of Determination into the parkingticket.com web site, Customer understands and agrees that parkingticket.com will prepare necessary paperwork for the Appeal hearing and ship said paperwork according to the Ship4Me Service Terms and Conditions. Please refer to Paragraph 5 for Delivery Fee and Paragraph 33 for the Standard Ship4Me Service Conditions.
11. Should Customer receive a Guilty Determination from the Appeals Board, only then, at that time, does parkingticket.com agree to refund the Guaranteed Dismissal Fee or Pay Per Ticket Fee, as long as Customer forwards to parkingticket.com the following paperwork within thirty calendar (30) days of the date of the Appeals Board determination: a copy of the parking ticket; a copy of the corresponding Vehicle Registration; the original signed (and notarized, if applicable) Dismissal Letter; the original signed (and notarized, if applicable) Appeal Letter; a copy of the first Guilty Hearing Determination; a copy of the second Guilty Hearing Determination; and any and all other attachments that were instructed to be attached in the original Dismissal Letter and "Instructions" page. Customer agrees to allow parkingticket.com up to ninety (90) days from Customer's latest submission, to review and verify all work matter, prepared by parkingticket.com on behalf of customer, prior to approving or declining a refund. Customer understands and agrees that if Customer does not forward all work matter, prepared by parkingticket.com on behalf of customer, -- as defined above -- to parkingticket.com, via fax or mail, within thirty (30) days of the date of the Appeals Board determination, then parkingticket.com will be relieved in full of its promise to issue any refund. Please note that each refund request must be made individually and all paperwork must be received within the initial thirty (30) day period. Should Customer request that parkingticket.com customize or modify any work matter, prepared by parkingticket.com on behalf of customer, from the standard parkingticket.com paperwork, then Customer agrees that parkingticket.com shall be relieved in full of its guarantee provisions. A violation of any terms or conditions stated in the Terms & Conditions of the parkingticket.com website will release parkingticket.com from its guarantee refund fee provision.
12. Customer understands, accepts, agrees and acknowledges that all input must be identical to the information from the parking ticket received by the Customer and that Customer is responsible for reviewing his entries prior to Checkout. If any entries or input made by the Customer are incorrect, Customer agrees and acknowledges that parkingticket.com will only be able to use the incorrect input or data entered by Customer to analyze the parking ticket in order to generate confidential, customized work matter, including but not limited to the Dismissal Request Letter. Should any work matter, prepared by parkingticket.com on behalf of customer, be incorrect, based upon incorrect information entered by the Customer, then Customer explicitly and expressly agrees that parkingticket.com will not and cannot guarantee the results of such work matter and that Customer will not be entitled to any refund or credit from parkingticket.com.
13. Customer authorizes parkingticket.com to share its parking ticket and related information to outside counsel including attorneys, retired Parking Ticket Municipal Judges, retired Police and Traffic Agents and other consultants as parkingticket.com may see fit at its sole discretion. parkingticket.com is a website and not an Attorney. parkingticket.com does not give legal advice. Do not consider anything on this website as legal advice. If you need legal advice please contact an attorney.
14. Customer agrees and understands that each Municipality has its own rules and regulations and that during the time of contesting a parking ticket Customer may receive one or more Penalty Notifications. Customer agrees that receipt of any such notices is not the fault of parkingticket.com and that Customer will not dispute any charges of parkingticket.com unless the parking ticket for which Customer is contesting has been found Guilty at both the Initial Hearing (first hearing) and the Appeal Hearing (second hearing) and only if parkingticket.com fails to issue a credit to Customer for the Guaranteed Dismissal Fee which Customer has paid within 90 calendar days. However, should parkingticket.com’s review of customer refund request identify that customer has not provided all the documents that parkingticket.com had initially or subsequently request customer to provide to the municipality that was included in either the Instructions or Dismissal Request Letter, than parkingticket.com shall be relieved fully from any refund claim.
15. Customer agrees to hold parkingticket.com, its shareholders, investors, officers, employees, consultants and related parties harmless from any claim. Customer further accepts and agrees that the maximum amount of any claim against parkingticket.com will be limited to the amount paid and collected by parkingticket.com for one parking ticket transaction. Should, for any reason, Customer take legal action against parkingticket.com, then parkingticket.com reserves its right to exercise any and all of its legal rights, and Customer agrees that parkingticket.com will be allowed to collect and receive reasonable legal fees from Customer should parkingticket.com prevail in any court or in any other action, including arbitration. Customer agrees not to make any claim against parkingticket.com with any form of arbitration association. Customer further agrees to accept the services of parkingticket.com on an "as is" basis, and agrees and accepts that parkingticket.com makes no warranty as to merchantability, nor does parkingticket.com provide any implied warranty for merchantability or fitness for or to a particular purpose.
16. Customer agrees to grant parkingticket.com sole and exclusive power of attorney for any parking ticket or Penalty Notice which Customer has entered into the parkingticket.com web site, and if requested by parkingticket.com, Customer agrees to sign Customer's name when and if requested by parkingticket.com and to forward an original copy of such Power of Attorney to parkingticket.com within five (5) calendar days of his/her receipt.
17. If Customer disputes any fee(s) or charge(s) from parkingticket.com, Customer authorizes parkingticket.com to charge Customer for the disputed amount(s) plus a $50.00 administration fee per dispute, plus legal, administrative, collection and court costs at parkingticket.com's sole discretion should the dispute be won in favor of parkingticket.com. In addition, Customer's access to the parkingticket.com web site may be placed on hold temporarily, suspended or cancelled at the sole discretion of parkingticket.com. Should Customer issue a chargeback via their credit or debit card company Customer agrees to release parkingticket.com from its Guarantee provision(s) as the initiation of a credit or debit card chargeback requires parkingticket.com to respond to the credit card company.
18. Cancellation Policy.
Customer understands and agrees that all work ordered by Customer is a special order, customized to their needs, based upon their specific circumstances. Accordingly, once Customer's customized work matter is created, it is non-cancellable and non-refundable unless Customer adheres to the standard policies and procedures to qualify for a full refund in the event that Customer's parking ticket(s) is found liable as per our standard guarantee as per Paragraph 11 and other terms and conditions. parkingticket.com will make exceptions to this policy, at its sole discretion, if Customer was involved in and affected by extraordinary circumstances that prevented Customer from following and adhering to the conditions and instructions of parkingticket.com, as detailed in paragraph 11 of this terms and conditions. parkingticket.com will be the sole arbiter and authority on deciding the extent of extraordinary circumstances necessary to qualify for an exception from this policy. Such cases will be reviewed and decided on a case-by-case basis depending upon the proven hardship customer represents.
- Non Ship4Me Service Customers: A full refund of Customer's fees will be made if Customer's Order is cancelled within 24 hours of Customer's Order and if no work matter, prepared by parkingticket.com on behalf of customer, has yet been delivered to Customer via the depositing of paperwork into Customer's online account and if customer has not made inquiries to parkingticket.com.
- Ship4Me Service Customers: A full refund of Customer's fees will be made if Customer's Order is cancelled within 24 hours of Customer's Order and if no work matter, prepared by parkingticket.com on behalf of customer, has yet been packaged and readied for shipping by parkingticket.com on behalf of Customer, as detailed in the "Detailed History" section of the My Tickets page located at the parkingticket.com website and in emails that Customer will receive, and if customer has not made inquiries to parkingticket.com.
19. Customer agrees not to assign their rights to any third party or to join in any suit naming parkingticket.com, its shareholders, officers, employees, investors, consultants or related parties to any court action. Customer acknowledges and agrees that this Agreement is solely between Customer and parkingticket.com. Customer agrees not to reproduce, distribute, publish or disseminate any material, regardless of the form in which it is received, for profit, gain or for any other reason, in any medium whatsoever.
20. Unauthorized use. Customer agrees not to copy, edit or modify any material prepared by parkingticket.com. Should Customer copy, edit, modify or otherwise alter customized work matter, which is defined as all work prepared by parkingticket.com for Customer, for their benefit or the benefit of any other related or unrelated third party and uses that paperwork, or a facsimile thereof, for the any purposes, including but not limited to the use of fighting a parking ticket for which they have not paid parkingticket.com, Customer agrees such use would constitute an unauthorized use of parkingticket.com's services. Customer further agrees that such unauthorized use of parkingticket.com's services will be billable and chargeable at a fee of up to five thousand U.S. dollars per occurrence. In such an event, Customer specifically authorizes parkingticket.com to charge Customers credit or debit card or banking account for such fees.
21. Non-Compete Clause. Customer agrees not to directly or indirectly enter into or engage in any parking or traffic violation or similar business either as an individual, partner, joint venture or venturer, employee, consultant, salesman, officer, director or shareholder of any business or corporation or otherwise, for a period of five (5) years after agreeing to these Terms and Conditions. Customer acknowledges and agrees that any breach of the covenants set forth herein shall cause irreparable harm to parkingticket.com and as such, damages would be difficult to ascertain. Accordingly, Customer agrees and consents and by executing this agreement specifically waives all defenses to the issuance of an order by any Court of competent jurisdiction granting such injunctive relief as the Company deems in its best interests and available at equity. It is further agreed that minimum damage to parkingticket.com from such a breach would be ten million U.S. dollars.
22. Copyright and Intellectual Property Clause. Customer acknowledges and agrees that all materials prepared by parkingticket.com are the intellectual property of parkingticket.com. Customer further agrees not to copy, edit or otherwise use such property for any purpose whatsoever without express, written and signed authorization by an Officer of parkingticket.com. Should Customer use such intellectual property without such written consent as described above then Customer agrees that parkingticket.com will be entitled to collect a fee from Customer up to five thousand U.S. dollars for each unauthorized use. In such an event, Customer specifically authorizes parkingticket.com to charge Customers credit or debit card or banking account for such fees. Should Customer contest such fees Customer agrees that it will compensate parkingticket.com for reasonable legal fees and related court costs to bring an action to collect such fees and to obtain an injunction by any court of competent jurisdiction against Customer's use of parkingticket.com ideas, information and or materials.
23. parkingticket.com does not charge or collect sales or any other tax. To the best of our knowledge, at the time of this writing, there is no sales, service or any kind of tax on the service provided by parkingticket.com. Customer does agree that should any tax be due on the providing of the parkingticket.com service it would be the responsibility of the entity or individual obtaining the service to satisfy that tax and that parkingticket.com is authorized by you, as the user, to collect that tax using your credit or debit card or banking account when and if applicable prior to, concurrent with or subsequent to its applicability.
24. Customer acknowledges they are not a minor and they have the legal authority to bind themselves to this Agreement. This Agreement is made and shall be enforced by the guidelines of the State of New Jersey and cannot be changed without the express written permission of parkingticket.com.
25. Should Customer provide parkingticket.com with a photograph of their image and/or a testimonial, Customer expressly authorizes parkingticket.com to use their testimonial and/or photograph in current and future advertising and promotions and agrees to release parkingticket.com from any fee for use of their name and likeness.
26. Parkingticket.com reserves the right to refuse to provide its services on a case by case basis.
27. 10-pack offer.
- The 10-pack offer is non-refundable.
- License and login information will be emailed.
- The offer renews automatically when 5 tickets are entered.
- There is no guarantee as to outcome of parking ticket dismissal letter(s).
- No cancellations on a 10-pack License are allowed.
- Renewals may only be cancelled with notice made in writing via certified mail, return receipt requested or overnight carrier, and will be charged a $25.00 cancellation fee plus a $50.00 per ticket fee for those tickets entered.
28. Business Solutions / Corporate Licenses.
- There is no guarantee as to outcome of parking ticket dismissal letter(s).
- All Licenses, where prevailing law allows, will renew automatically when the allotted amount of time, tickets, or volume has reached its limit, unless cancelled as per the terms below.
- No cancellations on License are allowed.
- After the original License is used up, the License renews automatically, where prevailing laws allow, and the renewal may only be cancelled with notice made in writing via certified mail, return receipt requested or overnight carrier.
- Should the renewal of the License be cancelled within 30 days of its expiration, a cancellation fee of $50.00 will be charged plus an additional fee of $50.00 per ticket entered. There is no cancellation or pro rata refunds or credits on the original/initial License.
29. Gift Certificates.
It is agreed by the purchaser and/or the user of the parkingticket.com website that the following additional Terms and Conditions shall supersede any and all other Terms and Conditions posted and stated herein for parking ticket Gift Certificates.
- parkingticket.com Gift Certificates are non-refundable and can be used at any time for up to one year from the purchase date, based upon prevailing law.
- For Gift Certificate purchases parkingticket.com makes no warranties or guarantees of any kind as to the dismissal or the reduction of any and all parking ticket fines.
- Parkingticket.com Gift Certificates are transferable from the purchaser to the original recipient. Recipients of parkingticket.com Gift Certificates are specifically prohibited from transferring their Gift Certificates to another party.
- Parkingticket.com Gift Certificates can only be used to fight parking tickets in New York City, San Francisco, Washington D.C., Boston, Philadelphia and Los Angeles.
- Use of the parkingticket.com website shall constitute a binding agreement between the parties and parkingticket.com to all the terms herein.
30. Telephone and Mobile Customers.
Customers using telephones,cellphones or other mobile devices to access the parkingticket.com website agree to abide by the same Terms and Conditions of all parkingticket.com Customers as outlined herein.
31. Boston parking tickets.
Part 1
Individuals and Businesses who wish to use parkingticket.com to contest parking tickets received in the City of Boston agree to abide by the rules and regulations of the Boston Parking Authority. Failure to comply with the specific adjudication rules will void the Guarantee provision. As of this writing, the Parking Adjudication process is as follows:
Requested Hearings
- A hearing can be requested in person at the Office of the Parking Clerk, Room 224, Boston City Hall, Boston, Massachusetts, or by mailing a written request to: City of Boston, P.O. Box 1626, Boston, Massachusetts 02105. All hearing requests by mail should include:
- a brief description of the nature of the dispute
- the plate registration number and parking ticket number(s) to be contested
- the name and address where correspondence should be mailed.
- The Office of the Parking Clerk will schedule an administrative hearing on any parking ticket if a hearing request is received within forty-five (45) days of the first mail notice
- For the purposes of Part 2, a hearing request shall be deemed to be received by the Office of the Parking Clerk:
- if by mail, on the postmark date
- if in person, on the date the request is made.
- The time restrictions imposed by Part 2 may be extended by the Office of the Parking Clerk if notice of the parking ticket had not been mailed either to an address on file with the Massachusetts Registry of Motor Vehicles or an address provided through correspondence from the registered owner of the ticketed motor vehicle.
- A parking ticket for which a hearing request has been received by the Office of the Parking Clerk shall be placed on “suspended” status, pending the outcome of the hearing. A parking ticket which is on “suspended” status shall not be eligible for further late penalties, seizure (booting) or license/registration non-renewal. However, a parking ticket in “non-renewal” status before a hearing request is received shall remain in “non-renewal” status.
- Notice of the time, date and place of the hearing shall be mailed by the Office of the Parking Clerk to the individual who made the hearing request. If an individual is unable to appear on the date provided, he/she may reschedule by appearing for the hearing within five (5) days prior to the scheduled hearing date, or up to ten (10) days after the scheduled date, between the hours of nine (9:00) a.m. and four (4:00) p.m. Individuals unable to appear for a hearing during this time period may appear for the hearing no later than three (3) months from the scheduled date. However, the “suspended” status, as provided by Part 5, may not be applicable.
Walk-In Hearings
Administrative hearings on a “walk-in” basis shall be offered in accordance with the following criteria.
- On a same-day “walk-in” basis to an individual who is the registered owner of the ticketed vehicle, and has been issued a disabled veteran/handicapped plate/handicap placard by the Massachusetts Registry of Motor Vehicles, pursuant to Section 2 of Chapter 90 of the Massachusetts General Laws
- On a same-day “walk-in” basis if his/her vehicle has been towed for a public safety violation within five (5) days of payment, on a “walk-in” basis, if his/her vehicle has been towed for a public safety violation.
Section 4. Abandoned Vehicle Hearings
Part 2
Guarantee Provision for Boston Parking Tickets:
Customer receive a guilty determination by mail or should Customer receive a request by the Office of the Parking Clerk to come in for a live hearing Customer must do that in order to remain eligible for parkingticket.com's refund guarantee. If Customer's ticket is not dismissed by mail Customer must go in for a live hearing and bring copies of the dismissal request paperwork prepared by parkingticket.com in accordance with the instructions noted in our paperwork. Failure to have an in person hearing - if your ticket is not dismissed by mail - will render our guarantee null and void.
Important Note: The City of Boston does not require you to pay a parking ticket found "guilty" by mail procedure as long as you promptly schedule an in person hearing. It is important to note that The Office of the Parking Clerk is not required by law to actually hold a full hearing by mail - only in person.
32. Philadelphia parking tickets.
Should Customer receive a guilty determination by mail or should Customer receive a request by the Parking Violations Branch to come in for a live hearing, Customer must comply with their request to remain eligible for parkingticket.com's guarantee.
If the ticket is not dismissed by mail Customer must go in for a live hearing and bring copies of the dismissal request paperwork parkingticket.com prepares for Customer. Customer acknowledges that failure to follow any directions issued in any fashion by parkingticket.com will void the parkingticket.com refund guarantee. Failure to have an in-person hearing when Customer's ticket is not dismissed by mail will render our guarantee null and void.
Important Note: The City of Philadelphia has the option of dismissing parking tickets by mail or in-person.
33. Ship4Me Service Conditions
Customer acknowledges and agrees that by selecting a Ship4Me Service option at the time of checkout, the following terms and conditions supersede any contradictory terms and conditions throughout this agreement.
- Customer authorizes parkingticket.com to insert his/her digital signature on the Authorization Form, Dismissal Request Letter, Appeal Letter and Order Form. Customer also authorizes parkingticket.com to insert their digital signature on other documents necessary to establish the proof of Customer's Order and/or to assist parkingticket.com in the fulfillment of its obligation to assist Customer in obtaining a dismissal or reduction of their parking ticket fine(s).
- Customer authorizes parkingticket.com to generate paperwork that will aide Customer in the dismissal of his/her parking ticket(s).
- Customer authorizes parkingticket.com to ship all work matter, prepared by parkingticket.com on behalf of customer, such as Dismissal Request Letter, Appeal Letter, and other related paperwork to the municipality where the ticket was issued.
- Customer authorizes parkingticket.com to prepare a facsimile of his/her registration certificate based upon Customer's entries and to submit same along with a facsimile of Customer's parking ticket, based upon his/her entries.
- Customer agrees to be held responsible for all parking ticket payments and requests the municipality to forward their determination directly to Customer.
- In the event the municipality forwards Customer's determination notice to parkingticket.com, parkingticket.com is authorized by Customer to make a timely payment of any amounts due based upon the ruling. Customer agrees and authorizes parkingticket.com to use its credit or debit card on file to make such payment to the municipality and to collect a fee from Customer in the amount of eight U.S. dollars.
- The Ship4Me Service is a new service that is in the beta testing stage. As such, Customer acknowledges and accepts that parkingticket.com may, at its sole discretion, temporarily suspend, halt or otherwise modify or terminate this service. parkingticket.com agrees to notify Customer of such changes through the email address on record and may, at its sole discretion, deposit parkingticket.com's customized work matter, including but not limited to the Dismissal Request Letter, into their online account on the parkingticket.com website. Accordingly, Customer agrees that it is Customer's sole responsibility to periodically check the My Account section of the parkingticket.com website to check on the status of Customer's Dismissal Request Letter and other paperwork prepared by parkingticket.com. Customer also understands and agrees that in all situations the Customer is solely and exclusively responsible for staying updated on Customer's ticket(s) status and if required by the municipality, to make all timely remittances.
- Customer understands and agrees that by selecting a Ship4Me Service shipping option at checkout Customer is entering a separate business contract between him/herself and Ship4Me Mailing Service, Inc. for the forwarding of Customer's Dismissal Request Letter and Customer-provided paperwork to the municipality. Customer acknowledges that parkingticket.com and Ship4Me Mailing Service, Inc. are separate business entities and that any issues regarding the packaging, shipping, and delivery of the Dismissal Request Letter and other related paperwork will be the liability and responsibility of Ship4Me Mailing Service, Inc.
- Customer further acknowledges and hereby consents that Ship4Me Service is a bona fide and acceptable substitute for otherwise delivering to Customer customized work matter prepared by parkingticket.com for Customer. As such, Customer agrees to fully release parkingticket.com from providing all such work matter directly to Customer.
34. Instant Rollover Credit. At any time subsequent to the placement of an Order, Customer may choose to terminate the process of contesting their ticket and shall be entitled to an Instant Rollover Credit in the amount equal to Customer's Order. Selection of the Instant Rollover Credit must be made online by Customer and such selection releases parkingticket.com from any refund review request made previously or subsequently by Customer. The Instant Rollover Credit is good for a period of one year and is non-transferable.
35. By accessing our website or our toll-free numbers or our helpdesk you have agreed to allow us to contact you by email, text, phone or any other available method to review the status of your activity with us.
